Feds: Indicted East Haven Police Officers Face New Additional Charges (DOC)

A new superseding federal indictment today alleges officers Dennis Spaulding, Jason Zullo and David Cari "conspired to injure, oppress, threaten, and intimidate individuals in East Haven in violation of their Constitutional rights."

The following is a press release from the United States Attorney for the District of Connecticut. Today's new federal indictment is also attached to this post.

David B. Fein, United States Attorney for the District of Connecticut, and Mary Galligan, Acting Assistant Director-in-Charge of the New York Office of the Federal Bureau of Investigation, announced that a federal grand jury sitting in Bridgeport returned a superseding indictment today charging East Haven Police Officers David Cari, Dennis Spaulding and Jason Zullo with conspiring to violate and violating the civil rights of members of the East Haven community.

According to allegations contained in the superseding indictment, from approximately 2007 through 2011, Cari, Spaulding and Zullo, while acting under color of law, conspired to injure, oppress, threaten, and intimidate individuals in East Haven in violation of their Constitutional rights.

It is alleged that Cari, Spaulding and Zullo engaged in unreasonable searches and seizures, including unlawful arrests without probable cause or based on false and misleading information.

Spaulding and Zullo are also charged with using unreasonable force during arrests, and all the defendants are charged with obstruction of justice as they wrote false reports to cover up their illegal arrests and assaults.

The indictment further alleges that Spaulding and Zullo intimidated, harassed and humiliated members of the Latino community and their advocates and conducted illegal searches at Latino-owned businesses.

Spaulding is additionally charged with following, intimidating and harassing advocates who worked to defend the rights of members of the Latino community.

The superseding indictment alleges 35 overt acts committed by the three defendants and others in furtherance of the conspiracy.

On January 18, 2012, a federal grand jury in Bridgeport returned an earlier indictment charging Cari, Spaulding, Zullo and John Miller with various civil rights offenses.

The superseding indictment removes Miller as a defendant, , and adds three additional counts against Zullo, including two counts of unreasonable force and one count of obstruction of  justice. In addition, the new indictment includes additional overt acts committed by the defendants.

The new charges against ZULLO stem from an October 2008 incident when ZULLO is alleged to have repeatedly hit a motorcycle carrying two individuals with his police car, causing the motorcycle to crash and the two victims to be thrown to the ground. After the crash it is alleged that ZULLO punched one of the victims who was injured and pinned to the ground.  ZULLO then prepared a false report to justify the assault.

Each of the three defendants is charged with one count of conspiracy against rights.  ZULLO is charged with three counts and SPAULDING with one count of use of unreasonable force by a law enforcement officer.  Additionally, SPAULDING is charged with two counts and CARI with one count of deprivation of rights for making arrests without probable cause.

Each of these counts carry a maximum term of imprisonment of 10 years and a fine of up to $250,000, except that the false arrest charge against SPAULDING which carries a one year term of imprisonment and a fine of up $100,000.  Finally, SPAULDING is charged with two counts and ZULLO and CARI with one count of obstruction of a federal investigation.

Each of these counts carries a maximum term of imprisonment of 20 years and a fine of up to $250,000.

U.S. Attorney Fein stressed that an indictment is not evidence of guilt.  Charges are only allegations, and each defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt.

This matter is being investigated by the Civil Rights Squad of the FBI’s New York Field Office.

U.S. Attorney Fein stated that the investigation is ongoing and encouraged individuals with information that may be helpful to the investigation to call the FBI at 212-384-2240.

Deputy United States Attorney Deirdre M. Daly and Assistant United States Attorney Krishna R. Patel are prosecuting the case with assistance from the Criminal Section of the Civil Rights Division.

I have a 16 year old son that might be able to help. He needs to earn some money. Do you have theRead More equipment? You can contact me with the info Thank you

I agree Jack is a good man. He however needs to better explain his financial problems. ForeclosureRead More doesn't go forward due to a mistake. Stand up and tell the truth. If you fell behind and got back on track tell us.

Jack is a good and decent man, He would be an asset to this Town if Elected to serve as our Mayor.Read More With that said we look forward to a new beginning in East Haven, One that can set the path to a new vision for the Residents who live here now and the ones yet to come. Yes its easy to say I like Jack

Gene, Jack is your party's pick, so what else are you to say. As to Jack, if he is anything likeRead More his father he IS a good man. But being just a good man doesn't cut it in todays small world politics. Jack has issues he needs to explain and I am sure when he time comes he will. But as to this article, I wouldn't expect anything else from the SHADOW. Wouldn't want him backing me for anything.

I asked the question and you gave me the answer I was looking for, and I thank you for that. As toRead More the rest of your dribble, doesn't deserve a response for EVERYONR knows all about the true Gene aka ******** Ruocco.

Richard, the Mayor kicked the CEO of the company that had the contract out of his office less than aRead More month after he won the election. The contract was with the town not the BOE. And if you think the only thing to check is if the panels are dirty, then it isn't worth answering you. A large investment of tax dollars was made and it is paying off with lower electric bills. The systems delivering these savings need to be checked, that is why people who were smart enough to sign a maintenance agreement did just that. Ask the BOE how the chiller replacement is going at the High School; due to lack of maintenance they lost two chillers that should have lasted at least 10 to 15 more years. Penny wise and dollar foolish is what this is all about, not the election year, but what else could we expect from you Richard. You have become the cheer leader of the administration.
Richard Poulton May 18, 2013 at 03:58 pm
Boy, you just know it's an election year. Gene, one question, when was this contract stopped?Read More Just now or some time ago, but seeing its getting "close' to November you just thought you would bring this up. Besides, shouldn't your question be aimed at the B of E, not the Mayor. And what is to be maintained anyway beside washing the panals now and then? You just keep us all informed now Gene.

Thanks Richard. Allison...I know that street is crazy!! I was just saying that the van makes theRead More stop sign so hard to see. I wish they would put a cop there too. Unfortunately, things don't get attention until something bad happens.
AllisonWonderland Beckert May 16, 2013 at 05:58 pm
Please, a parked Van you are worrying about???? Every Morning in that same area of Chidsey,Read More Thompson, Prospect. etc, Cars, Trucks etc. Blast thru the Stop Signs and continue on their merry way. I'd worry about the kids walking to the bus stops and school being run down by these careless drivers... EVERY DAY I SEE IT !!!! I wish the Police Department would put an unmarked car in the area.. The Town of East Haven would be rich from ALL the Fines !!!!!
Richard Poulton May 16, 2013 at 05:47 pm
Anne, go to town clerks office and get a copy of Town Codes, Article ll, Section 12-16 and 12-17.Read More Section 12-17 defines an abandoned M/V as any M/V which is "inoperatable", or unregistered and is left in one location for a continuous period of more than 24 hours. Then call the Chiefs office and hit him with that. If nothing happens go to next Town Council meeting and during general public comments ask WHY nothing is done when complaint is made. Good luck.
