Lawyer: East Haven Police Case 'Reeks of Identity Politics'

Norm Pattis, attorney for one of four East Haven officers indicted for alleged civil rights violations, argues the charges "look flimsy" and has filed for a dismissal. And another CT lawyer has also publicly criticized how the DOJ has handled the case.

 

The lawyer for one of the four East Haven Police officers indicted last month for alleged civil rights violations against Latino residents has argued the charges "look flimsy, like a trumped up set of allegations," and has asked for the case against his client to be dismissed.

And a second Connecticut lawyer, who is unaffiliated with the East Haven case, has also publicly criticized how federal officials have handled the affair, arguing that prosecutors engaged in "inflammatory rhetoric and gratuitous aspersions on the accused" in relation to their announcement of the indictments.

Motion to Dismiss

Norm Pattis, the criminal defense attorney for East Haven Officer Jason Zullo, has asked to have the case against his client dismissed in part because of the “Barnum-like pre-trial publicity" by federal officials, according to a variety of press reports.

Pattis filed the written motion to dismiss the case with the court yesterday.

In that motion, the Connecticut-based trial lawyer reportedly wrote that "far from behaving like sober ministers of justice, the prosecution has engaged in the cheap theater of press conferences and name-calling in an effort to forever associate the name 'East Haven' with dark and sinister connotions."

Pattis continued, criticizing federal officials for holding the Jan. 24 press conference that announced the unsealing of the federal grand jury indictments against the four officers — and the tone and tenor of comments made by federal officials during the media briefing.

"The Justice Department opted to supplement this unsealing with a press boondoggle to highlight it's national campaign against racial profiling," Pattis wrote.

'Identity Politics'

Pattis' remarks in the dismissal echos those he made in a post about the East Haven case on his blog Monday.

In "Crossing the Line," Pattis argues that the federal indictment against Zullo and the other officers "looks flimsy," like a "trumped up set of allegations that could not withstand the light of day in civil court."

"The case reeks of identity politics: Four white male cops being prosecuted by a couple of female prosecutors for allegedly violating the civil rights of Hispanic folks; the prosecution pushed by a Justice Department some suspect of having abandoned race neutrality in the enforcement of the law; a bevy of Yale Law students cheering them on with the glee of zealots unschooled in the reality of the streets," Pattis wrote.

He added that he fully expects Zullo to eventually walk out of the "courthouse a free man."

"My client is being used to serve an agenda unrelated to the merits of the case pressed against him," he wrote. "My job is simple: I will protect him."

'Gratuitous Aspersions on the Accused'

And Pattis is not the only Connecticut lawyer who has been publicly critical of the U.S. Department of Justice's handling of the case against the East Haven police officers.

In a recent opinion piece published in the Connecticut Law Tribune, Karen Lee Torre argues that the timing of the release of the Justice Department's civil investigation findings that East Haven Police had mistreated Latino residents and engaged in racial profiling was "deliberately" and "unconscionably timed to coincide with the criminal indictment."

The New Haven-based attorney continues, writing that the announcement of the indictments last month was also "made most public way," and filled with "inflammatory rhetoric and gratuitous aspersions on the accused," which federal officials knew "would be TV broadcast, newspaper headlined, and Internet viral."

"Among the improper commentary: statements denouncing the accused officers as a 'cancerous cadre' and 'bullies with badges," the Connecticut lawyer wrote,

Torre added that the U.S. Attorney’s office usually announces indictments by paper press releases only, which usually steer clear of "any statements that amount to personal attacks, undermine the legal presumption of innocence, or work to poison the jury pool."

'Rhetoric by Federal Offiicals'

The lawyer also asks readers to consider whether "you would ever hear such rhetoric by federal officials" at a press conference held to announce the arrests on criminal charges and the holding for deportation of 12 Ecuadorians or Mexicans illegally in the U.S.

"Imagine one of them taking to a public podium to denounce those arrested as a 'cancerous cadre' and 'low-lives with stolen Social Security numbers.' I could just see the headlined condemnations in the press, and hear the hysterical screams in the hallways of Yale Law School," Torre wrote, referring to the ongoing civil lawsuit brought against East Haven Police last year.

I feel the same way as Lisa. All of the people who allegedly were profiled, and thier attorneys should start to show the public the records of what led up to the supposed charges with credibility. Te info released just recently clarifying what actually went down with Garcia just turns tings around a bit! Hello, he was avoiding a DUI checkpoint after leaving a bar and got caught after almost hitting a pedestrian, and backing up on a sidewalk, and then fleeing his car! He lost his license in court!

The only comment I am going to make for now is that I said the truth would come out, and we will see just who was involved in this. I suspect that many of us won't be to surprised at some of the names. East Haven was made a scapegoat at the hands of some of our very own.

I am not a fan of Pattis and he is reaching far in this action. BUT, I do have to agree with the comment made by Atty. Torre, as stated in the past paragraph of the article. REALLY think about what she has said. I am still waiting for the indictment for perjury on that one male that wanted out of the case for he lied, made up his story. ALL statements made in any law enforcement investigation are taken under oath. Make up a story, swear to it under oath as a true testiment of fact, and it is found not be be true. Go to jail. I will guarantee that will never happen.

I not only agree with Pattias' arguments , I also agree with Karen Lee Torre's arguments and comments .
This started out as a witch hunt and turned into a Three Ring Media Circus , not meant to improve the East Haven Police Department as claimed but to impede it's officers from doing their job !
I've lived on Rt. 1 for just over 5 years now , I've witnessed many a traffic stop and
DUI check points , I have never seen a Police Officer be anything but polite and professional .
Also because o the Media Circus this story has spread country wide making it almost impossible to find an impartial jury .
As far as the Yale School of Law Students are concerned they are STUDENTS still learning the laws , they still have to finish earning their degree and pass the state bar exam before they can enter into any legal field so why should their opinion hold such weight ?

Sounds like he is posturing for a deal which I think all these fellas will realize they have to go for. They make a deal, pay a fine and dont do jail time.Then they and their families can go on with their lives and not have this hangin over them for two years. Person really responsbile for all this is a sittin home countin his $100,000. These young fellas still had their whole lives ahead of em. Careers, etc. He ruined it for them by not bein the leader they needed, by tellin em these were toothless sharks, by tellin em it will all go away keep doin what ya doin. Funny how chest-thumping anti-"identity politics" people think it is an issue that the USAO lawyers are women, but not that the defense lawyers are all men. Funny how they identify as the problem in the case the fact that the Latinos are complaining about being harassed, arrested, and beaten by the lawful authorities, and not that the white cops did any of those things. Who's "identity politics" are the problem here? The ones tapping out their racial fantasies about Latinos to each other on their car-to-car communication devices or the people trying to run their businesses? And as far as the Department goes, have these lawyers bothered to read what the justice department wrote? What the Department's own experts wrote? NO IA procedures, no requirements to report the use of force, no chance whatsoever that a police officer would be held accountable for using excessive force. What did the Town expect to happen?

Tony, the comment you made referring to the DoJ reports findings and what was written by them, you mention three of the items within that report. Just a little FYI for you. The writing of these type of things for a PD fall to the responsibility of the police commission. Maybe you should ask Mr. Brow the past chairman why those things weren't done under his watch. PC's write policy, a chief enforces that policy. Maybe they should have spent a little more time re-writing the departments proceedual manual, in most cases called "General Orders". But maybe if the "licence plate" incident was handled better by Chief Gallo we wouldn't be in the spot we are presently in.

Patrick....If you haven't done so read the entire indictment. If 25% of what is alleged can be proven the case is far from ridiculous. Pattis has to go this way. He knows they will not dismiss anything. It is just what he does. Although it appears that some of these Latinos are illegally in our country and drove unlicensed our laws dont allow officers to stop them w/o probable cause.

OK Betty, since you think you have the better half of knowledge, re-read what I mentioned above to Tony. All I wrote was that the three items he brought up fall to the responsibility of a PC. I also mentioned the "licence plate" incident that started all this should have been handled better, and I agree it was not. So, before insulting someone you should check on how PD's make there rules and regulations. Just to mention I probably have forgotten more things related to a PD then you have currently in your head. My credentials are beyond reprouch.

And to ASmith, we are miles apart on politics but the idea of a chief's contract is not new, many cities/towns have such. But I believe this will call for a change in the charter, which should be looked at in whole anyway. Way outdated.

Hey Rich, just research the BOPC meeting minutes starting back in 2008. Rewriting the policys was undertaken immediately after Brow became chariman. Its also noted numerous times over the last 3 years, of Gallo's disregard for his involvement in and compliance to directives issued by the BOPC.
And Mayor Capone was arrested by one of the politcal players, after numerous issues with him sitting down the beach flapping his gums about his politcal issues. Again, one of Gallos protected few who could do what they want. Why do you think he's running that Gallo's gone.
How many business dealings did the names Pat Romano, Joe Maturo, Mike Sorbo and John Finkle all end up involved with?
Why wasn't Sorbo's aquiring of ETV property investigated? yet Gallo gets personally involved in minor accidents involving the town attorneys wife.

I did not read all the news the press put out. Let us see what is true and not true. Your calling them guilty before they have a fair hearing. Conpone lost by 31 votes, so what she lost.

The EH police scandal is a "tip of the iceberg". The Federal investigation extends far beyond the PD. What will you bootlickers say when members of the Town government and the BOE start falling like dominos? When some of you yourselves, who've benefited by having hands in cookie jars, are served arrest warrents? You loud mouths! Do you really think you're above the law?

And when the indicted are proven guilty in a court of law, what will be your excuse? Rats are already singing to save their own hides. Already now, behind the scenes, deals are being cut. So much for that "Thin Blue Line". LOL

There is much corruption in this town going back generations. I saw it back in 1971 when I first moved here. When the first few layers of the onion are peeled back, the onion begins to stink. The onion will stink severely until the rooten core is finally rooted out.

Interesting that coronado shows up on Patch on February 15. Until this date he was never heard from on any Patch.
Oh that's right he was resurrected like Jocobo since both had been dead for many years.

I would like to know what I have said that you claim is filth. Politics yes because that is all that is happening since your President came into office. You are uncomfortable , boo hoo. you want social change, you really mean socialistic change.
How about that settlement today on the ILLEGALS getting 350,000. in a settlement orchestrated by the Feds and the left wing yale law school. Hell if anyone is illegal in Mexico or any other Hispanic, Latino country they would be put into jail and immediately deported. Here in the USA we allow them to come in, however join with us learn how to speak our language fly our flag and not your own. Did you see the ILLEGALS who received the 350,000 today being interviewed they needed an interpreter (Spelled Correctly coronado).
BTW you and Jocobo are not of Hispanic decent yet you act like you are, both of you should be ashamed of what you are doing.
