Update at 1 a.m. Tuesday

Leaders from St. Rose of Lima Church in Fair Haven, who spearheaded a civil rights lawsuit against the East Haven Police Deparrtment, issued a press release stating that the U.S. Department of Justice's findings supports their allegations of racial profiling and police brutality against Latinos by the East Haven Police Department. 

“Two years ago this month, our congregation and others in the community joined together in a vigil recognizing the start of this investigation,” said Father James Manship, a priest at St. Rose of Lima Church. “The Department of Justice’s announcement today vindicates the complaints of racial profiling by Latinos that have devastated our community for years.” 

Angel Fernandez, a leader of the St. Rose Pastoral Council, stated: “Neither the Town of East Haven nor the East Haven Police Department has been willing to take any serious steps to curb anti-Latino abuse and harassment. Only a zero-tolerance policy toward harassment of Latinos and an end the intimidation of police officers and community members will address the community’s concerns.”

Update at 7:30 p.m.

East Haven Mayor Joseph Maturo had some strong words following this afternoon's U.S. Department of Justice's press conference announcing that it had found the East Haven Police Department had engaged in discrimination against Latinos.

"I'm kind of upset," Maturo told East Haven Patch earlier this evening.

The mayor, who did not attend the Justice Department's press conference in New Haven this afternoon, said he felt the federal agency's report was "slanderous to our community" and "slanderous to our police department."

Maturo said he felt the department's findings did not include specifics regarding when and where the incidents of discrimination occurred, as well as "who they happened to and the officers involved."

"It just gave these broad statements (about things) that I'm not sure exist in our police department," he said of the report.

In addition, Maturo criticized the Justice Department for how the federal agency notified his office of today's press conference.

The mayor said his office did not receive official notification about today's 1 p.m. conference in New Haven until shortly after 12 p.m. this afternoon.

The Justice Department sent out a press release to local news media outlets alerting them of today's press conference just after 10:30 a.m. this morning.

"It seems very political to me," Maturo said, adding that members of the town's previous administration — including former Deputy Director of Town Affairs Paul Hongo — were in attendance at today's press conference. Maturo, however, said he did receive a briefing from Justice Department officials regarding their findings via telephone later this afternoon following the press conference.

And the mayor added that he is ready to work with federal officials to help improve the town's police department.

"I'm ready to help work to make our good police department a better police department," he said.

The East Haven Police Department has "engaged in a pattern or practice of discrimination against Latinos in violation of the Constitution and federal law," according to the results of a two-year U.S. Department of Justice civil investigation.

"The residents of East Haven should not have to choose between effective crime-fighting and constitutional policing," U.S Attorney David Fein said at this afternoon's press conference in New Haven that announced the investigation's findings. "By addressing the serious deficiencies we've uncovered, EHPD will not only ensure constitutional policing, but will also give the men and women of the EHPD the support they need to combat crime effectively."

A dispatcher with East Haven Police said that newly reinstated Police Chief Leonard Gallo would not yet be making a public statement regarding the Justice Department's findings.

Calls placed a short time ago to East Haven Mayor Joseph Maturo and East Haven Police Union Local 1662 President Sgt. John Miller were not immediately returned. A Justice Department official said at today's press conference they would be meeting with Maturo and other town officials regarding their findings this afternoon.

Launched in September 2009, the investigation was conducted under provisions of the Violent Crime Control and Law Enforcement Act of 1994, the Omnibus Crime Control and Safe Streets Act of 1968 and the Title VI of the Civil Rights Act of 1964.

Specifically, the Justice Department reported that its investigation found the East Haven Police Department targets Latinos for traffic enforcement and treats Latino drives more harshly after traffic stops in violation of the 14th Ammendment, Title VI and the Safe Streets Act.

The federal investigators further stated that they found the East Have Police Department "willfully enabled discrimination by failing to put in place basic law enforcement practices and procedures used by law enforcement agencies across the country to prevent discrimination."

The Department of Justice stated their findings are based upon:

  • a statistical analysis demonstrating that Latino drives are disproportionally targeted for traffic stops;
  • an analysis of traffic stops showing that officers used non-standard and, in some cases, unacceptable, justifications for stops that are not employed against non-Latino drives, and post-stop treatment that shows EHPD treating Latino drivers more punitively than non-Latino drivers;
  • serious incidents of abuse of authority and retaliation against individuals who criticized and complain of EHPD's discriminatory treatment of Latinos; and failure to remedy a history of discrimination and a deliberate indifference to the rights of minorities, including EHPD's failure to guide, train, supervise and discipline officers engaged in unlawful discrimination 

The Justice Department also found a number of serious deficiencies in EHPD's management, oversight and accountability systems that have enabled a discriminatory policing.

The federal officials said these deficiencies include:

  • a failure to collect and report traffic stop data in accordance with state racial profiling laws;
  • a failure to implement policies prohibiting discrimination;
  • a failure to hold officers accountable through internal investigations;
  • a failure to provide limited English proficient Latinos with appropriate language access;
  • and a failure to abide by individuals' consular rights.

In addition — although officials stated they were not making formal findings — the justice department also noted two areas of "serious concern" regarding allegations of use of excessive force and unconstitutional search and seizures.

"These findings dhow that the East Haven Police Department systematically violated the constitutional rights of people it is supposed to serve and protect. By failing to have in place the most basic systems designed to protect individuals form unlawful discrimination, EHPD has fallen short of its obligations," Thomas Perez, assistant attorney general for the Civil Rights Division, said. "The recommendations we make will put the police department on path toward correcting the serious deficiencies that have long played the department and regaining the communities trust."

The justice department's independent investigation was conducted by department attorneys, investigators and police executives and other experts who interviewed EHPD offices and resident in East Haven. 

The investigation also involved an "exhaustive review of documents and data, including EHPD policies and procedures, incident reports and traffic stop activity.

This civil investigation was separate from any ongoing criminal investigations into the East Haven Police, justice department official said.

They added that federal law permits the attorney general to initiate a civil action in the name of the United States against the town of East Haven, East Haven Police Department and its officials "to remedy the pattern or proactive of misconduct and ensure compliance with the Constitution and federal law."

Justice department officials reported that they will work with East Haven officials to obtain their voluntary compliance through a court-enforceable agreement that will lead to sustainable reforms.

"Should the EHPD and East Haven choose not to cooperate in reach an agreed-upon remedy, the department may seek relief unilaterally from the federal courts," the justice department officials reported.

The civil investigation was conducted the Special Litigation Section of the Civil Rights Division in coordination with the U.S. Attorney's Office for the District of Connecticut and with the assistance of expert police consultants.

I've lived in East Haven for 25 years. I can't believe that man, Maturo, actually went on camera with that BS. Mayor Capone did exactly the right thing by putting Chief Gallo on leave. She was privy to a lot of facts about this case but was not allowed to speak about it. The problem with the PD did NOT start during her administration. It was rampant during the 10 years Maturo was mayor and the "Good Ol' Boys" used to joke about it (remember the T-shirts?) Who does he think he's kidding? The republicans effectively used this issue during the last campaign, pitting the EHPD supporters (the factless) against Mayor Capone. Well, now they got what they wanted. They certainly succeeded at putting East Haven on the map for having the most uninformed, gullible electorate in the state who put this backward, ignorant and racist administration back in office. It should get real interesting from here on. God help us.

This is all thanks to the lack of leadership in the police department. We have some very fine officers who are the absolute best in the area. I wish they didn't have to go through this horrendous event. The mayor needs to realize that we need new leadership back in the department. The former mayor made the right move by doing what she did in all aspects. I only hope the new mayor will do the same.

Hey how about this don't break the law and you wont have to deal with any police force in any town. I am a white female who would love to pull a race card when dealing with the police, etc but oh that's right the caucasian community doesn't have that luxury. Seems simple people have your cars registered, insured, have a valid license and obey the rules of the roads set forth by the department of motor vehicles and you won't have any problems !!!!!!!!!!!

Let's just say from personal experience, I have absolutely no respect for illegal residents, or anyone that supports them. I stand by my statement, illegals have no place here, period. Do it the right way like the rest of us had to, or go away. I again thank our PD for doing the job they are paid to do, uphold the law and arrest those who are not law abiding citizens, and that certainly includes illegals. Lets see. The new mayor reappoints Gallo just before this report comes out, getting him back online before the true story came out. Gallo's first action is to bar the Board of Police Commisioners access to the department premises, an idiotic action he had to rescind almost immediatley. Now the report comes out with findings that anyone with an open mind and common sense is not surprised to hear. Maturo's reaction is that the report is slanderous? Who would like to bet that Mayor Maturo could not define "slander" if given a week to research it? This town is a joke! The fact that we re-elected a man who obviously lacks in intelligence, common sense, integrity and backbone is a disgrace. He is off to a flying start damaging our already putrid reputation. Our reputation as a bigotted town will only improve when good people will stand up and address the long standing problem we have with treating everyone fairly. A true leader would listen to what the report has to say and take decisive action to remedy the problems. Instead, be ready for blind denials and subtle innuendo blaming the minority victims for daring to try and make a nice life for themselves in this town.

Today’s events by the DOJ are just the beginning of a sad era for East Haven. This day will show that a change in Mayor, Town Attorneys, Chief of Police and Police Commissioners will not make the DOJ and FBI leave East Haven until the truth is out for all of our citizens to see for themselves just what has been happening in our town.
It’s too bad that a good administration paid the price. In the end East Haven is the big loser because of this mess.

EHPD needs to obtain a 'Plate Finder' like Branford did. It does a wonderful job of finding mis-use of plates without 'profiling'. Have the sector cars patrol with it near the NH line and get them as they try to come in. The Western end of Main street seens to be getting a little south of the borderish....keep pushing them back west where Mayor D wants them!

They have a plate reader and a list of stolen plates from another state. they were using the plate reader to pull over all cars that contained these stolen plates and guess what, all Latinos. So is this really racial profiling or the EHPD doing their job?

I wish Joe just kept quiet yesterday. How about telling the local media that the EHPD is looking forward to working with the DOJ and following through on their suggestions. He made us all look terrible yesterday. I have supported Joe in the past. I'm ashamed today. April didn't need to hold a press conference either...but I understand why she did. We have good police officers here. Men and women that care. When you have bad leadership in any business, everyone looks bad. Joe's comments may turn up the heat a bit. If these rogue cop clowns would only have done their jobs properly (lawfully uphold the law), they wouldn't have to worry about Manship or anybody else videotaping them. They wouldn't have to falsify reports throwing the entire department (including the many good cops) under scrutiny.

He fooled people into voting for him and within weeks proved he has no business being the mayor. Is there a law against his ridiculous, full of lies campaign strategies, that's what people should pursue. He lied about paying two chief and he lied about rollback checks. Now he's blaming the old administration for the problems with the PD, how ridiculous. He reappointment his buddy after Capone made a wise decision that protected the towns people from further backlash from a rogue, non-compliant supervisor. He clouded all that reality and did what he wanted. He set the taxpayers up for more legal expenses. If you voted for him because of his lies you should do something about it. It's based on liberal "politically correct" tripe. But go ahead and keep blowing smoke, and mis-information about what it is, and what it means. The report is about targeting Latinos and civil rights. No one anywhere is asking for law enforcement to turn a blind eye to anyone breaking the law. Think about how insane that is before spewing it to deflect from the real issue - the Chief has created and allowed a Police Department to disregard the laws of the land and act as it chooses. I just hope next week the Police don't decide to unfairly target blonde hair white males with blue eyes or I could be the one pulled over for no reason!!

If the west side of Main Street where a nudist colony, it would stand to reason that a "dis-proportionate" number of naked people would be pulled over in traffic stops! Similarly if Aryan people where in the majority there, you might "feel targeted"! What I'm not hearing is HOW do the police pull over a car driven by a Latino without being accused of wrongdoing for it? My guess is that's the real issue and the one to be resolved. I feel like a lot of people either don't know or don't want to admit the facts. For off, there was never three police chiefs. We had a chief on administrative leave, a deputy chief which was recommended by the PERF report, and an acting chief who was paid his inspector pay. Also, all the issues happene under police chief Gallo, not under another chief. Lastly, most police officers aren't involved in this. We have some great officers they are just caught up in a situation with the bad officers.

Anyone who says there is no detail in the report must not have read it. BTW - The 23 page letter to Maturo has plenty of detail in it, perhaps he should READ it! It is interesting that a town with plenty of citizens of Italian descent is so prejudice and racist. Just imagine 75 years ago - when your Italian immigrant parents and grandparents came here, they may have had a green card or maybe they were citizens, but because they spoke broken English and couldn't read English, the White police wanted the 'without papers' WOPs out of town. It is just a new group trying to make their way in the good ol USA. If you don't like it maybe you should look into getting a ticket onto a boat headed for Italy.

Here's the fact, seeing you are a little slow, you are right about our immigrant parents and grandparents, and maybe even ourselves, but the fact is we came here LEGALLY. We learned to speak and read english. We got jobs and took care of ourselves and our families. We respected the laws of the land that we lived in. And we didn't have to "press one for english". It's is really simple, everyone is welcome as long as you do it legally like we all had to, learn the language, obey the laws like we all have to, take care of yourselves and pay taxes like I do, and don't rely on my tax dollars to take care of you. Why do so many of our fine citizens believe that the DOJ is really basing their findings on legitimate stops for unregistered vehicles. Do they really believe the Feds are that stupid. Open your narrow minds and admit there were real civil rights violations here. It sounds like we have a large section of town raised by Archie Bunker when they defend the actions of the police based on "THEY don't speak english " or "THEY drive unregistered cars" or "THEY should obey the law like the rest of us" . A two year investigation an unbiased group of professionals has resulted in this action by the DOJ. Don't try and blame it on the victims.

None of us don't really know what the facts will actualy show as far as this investigation is concerned, for it has yet not been completed. But I strongly recommend that the readers research Thomas Perez, the Asst. Atty. Gen. in the Civil Rights Div. Biggest concern is when complaints were made by whites, his office rejected them. Lawyers in his office were transfered out for complaining when white cases were brought up, and was blatently pushing for black & hispanic cases only.

Look at what happened in the voter intimidation incident with the Black Panther party during the 2008 presidential race. When investigated by the DofJ, all attorney's involved in pressing the case against the black group were transfered out and prohibited from testiying. This man has a history of picking on whites, and no doupt is under orders from Eric Holder. As well as there is a perjury case being presented against Perez for lying in investigations to make his case(s). Just research this man and make up your own mind.

Patrick, you sound like a smart guy - It certainly has been amusing reading your discourse with Luigi. At least now I don't feel alone. He jumps all over me whenever I post in here. Its great to have a local arena to post our thoughts and concerns. However, after reading in here for awhile, I sometimes come away thinking Luigi and Rosie are the same person, just male & female alter egos on a mission to dumb-down this site. I gave up on any rational conversation. The HuffingtonPost.com ran the EHPD story yesturday, now that's a place where you can get into some interesting commentary and ideas at a higher level of intelligence than you will find in here. Every Latino & Hispanic family here lives in fear of the EHPD. We're not talking illegals here. We're talking Latino citizens who get caught up in the EHPD over-zealo­us and routinely disrespect­ful roustings in search of law-breaki­ng "illegals"­, mostly in motor vehicle stops. Of course, there are some illegals but they are small in number compared to the many who are harrassed because of their ethnicity. East Haven has been a notoriousl­y racist town for years. It wasn't all that long ago when crosses were burned in the shoreline section of the town and black people were very aware they were not welcome here. To this day, there are few black families living here. Police sported "Boyz-On-T­he-Hood" tee-shirts depicting cops slamming (obviously­) black men on the hoods of cars. All this condoned by the "Good Ol' Boy" Maturo admin. that was recently put back in power. We had a 4 year break with Mayor Capone, who had taken steps to remedy this ugly situation, including putting the Chief Of Police on leave while the DOJ did its investigat­ion. Unfortunat­ely, she lost re-electio­n this past Nov by 35 votes. Now we're back to the same people who turned their back on all the racist practices for many years. In fact, the 1st thing Maturo did when he assumed office was reinstate the Chief Of Police just days before claiming he was "ambushed" by the DOJ report. This town has taken a giant step backwards and I fear the worst is yet to come.

Welll I suppose one would think that if all they were used to is FOX, Limbaugh &
Beck hate radeo & similar right-wing web sites, but it doesn't make it true. Some of the reporting may be a little over the heads of the un & misinformed. All I can do is lead the horse to water....
