DOJ: 'Chats' Display Alleged Anti-Latino Bias
East Haven Police Officers Dennis Spaulding and Jason Zullo's "car-to-car" communications used as basis for federal prosecutors' argument against Zullo's release from home confinement.
As part of their argument not to change the home confinement conditions of one of the four East Haven Police officers arrested for allegedly violating the civil rights of Latino residents and others, Department of Justice officials released transcripts of snippets of recorded communications between two of the men while on duty.
And according to the federal prosecutors, the "car-to-car chats" support their allegations that Officer Jason Zullo "engaged in conscious and deliberate conduct against a racial minority group that he apparently believed threatened to disrupt social order in the Town of East Haven."
Screen grabs of the transcripts of those recorded communications between the two officers, which took place in 2008 and 2009, are posted in the gallery that accompanies this story.
The transcripts were part of the federal prosecutors' "Memorandum In Opposition of Bond Modification" — which is also posted in the gallery — filed with court yesterday.
Changes to Confinement
Zullo and fellow Officer Dennis Spaulding, who is also one of the four indicted officers, appeared in U.S. District Court in Bridgeport yesterday seeking changes to the conditions of their release since last month's .
East Haven Officers David Cari and Sgt. John Miller were also arrested but were not the subject of yesterday's court hearing.
According to Thomas Carson, spokesman for the Connecticut U.S. Attorney David Fein's Office, Federal Magistrate Holly B. Fitzsimmons ruled that Zullo will be released from home confinement, with electronic monitoring, between the hours of 9 a.m. to 5 p.m. each day.
And Spaulding "perfected his bond and remains on full home confinement," Carson told East Haven Patch.
He added that neither officer is permitted to travel into East Haven.
'Criminal Intentions'
In their Memorandum In Opposition of Bond Modification submitted to the court — which is included in the gallery that accompanies this article — the federal prosecutors argue that in addition to alleged incidents of civil rights violations "Zullo’s criminal intentions regarding the Latino community are also evidenced in his own words."
The federal prosecutors continue:
Zullo’s criminal intentions regarding the Latino community are also evidenced in his own words. Zullo communicated with other officers, including a co-defendant, by way of car-to-car chats between mobile data terminals in their patrol cars. As set forth in the Indictment, Zullo stated that he “likes harassing [sic] motorist[]” and referred to “persons who have drifted to this country on rafts made of chicken wings and are now residing on Maint [sic] St East Haven.”
The memorandum then includes a graph with brief transcripts of selected portions of those recorded communications between Zullo and Spaulding.
The transcripts, which are included as images in the gallery above, have not yet been played in court.
The federal prosecutors continued their argument against changes to Zullo's home confinement conditions, stating that:
Zullo’s actions and conduct have created fear for members of the Latino community who believed that they were powerless to do anything because the abuse that they suffered was from the very police officers who were sworn to protect them. The car-to-car chats demonstrate that Zullo engaged in conscious and deliberate conduct against a racial minority group that he apparently believed threatened to disrupt social order in the Town of East Haven. Many witnesses have spoken to the Government about their fear of East Haven police officers and the psychological and physical abuse that they have suffered.
'Trumped Up Set of Allegations'
Zullo's defense attorney, Norm Pattis, however, that the charges against his client "look flimsy, like a trumped up set of allegations," and has asked for the case against his client to be dismissed.
Pattis filed the written motion to dismiss the case against Zullo with the court on Feb. 9.
In that motion, the Connecticut-based trial lawyer reportedly wrote that "far from behaving like sober ministers of justice, the prosecution has engaged in the cheap theater of press conferences and name-calling in an effort to forever associate the name 'East Haven' with dark and sinister connotions."
Pattis continued, criticizing federal officials for holding that announced the unsealing of the against the four officers — and the tone and tenor of comments made by federal officials during the media briefing.
"The Justice Department opted to supplement this unsealing with a press boondoggle to highlight it's national campaign against racial profiling," Pattis wrote.
Pattis' remarks in the dismissal echos those he made in a post about the East Haven case on his blog last week, in which he concluded that he fully expects Zullo to eventually walk out of the "courthouse a free man."

Julie, If the DOJ thinks that what is presented above is cause for a case and are presenting such to support their decision. They have a long way to go. I don't like "snippets." As I have seen all to often they do not always portray the total story. Where should I direct my inquiry to have ALL evidence presented in total.
Nothing in that CHATTER in itself is daming. 1st Ammendment ... Freedom of Speach... 4 Ammendment " In ALL Criminal prosecutions, the accused shall enjoy the righ tot a speady and PUBLIC trial..... And yes I carry The Constitution with me at all times.

It reads like they released enough evidence to accomplish their goal of home confinement. There does not seem to be a reason to believe those are the entire recorded conversations. The chatter themselves looks pretty damning.

This is MINOR but erefutable proof of discrimination. Like I said, MINOR. Is it cause for much? I don't think so. But it is something. Personally, I hate seeing our PD go through this. We have some of the best officers and the absolute best Deputy Cheif. I certainly hope this gets resolved soon.

This is the evidence???? Are you kidding?? Other than the mexicans comment, I see no evidence. Asking if they are running the guy through ICE, there is nothing wrong with that. Actually, I wish MORE officers would do this so that we can ship the illegals back. This has NOTHING to do with race...this has to do with legal vs illegal. And illegals does not belong, and do not have any rights under the constitution. The constitution is for citizens. What a waste of time and money.

FYI: The Boumediene Court held that it was unconstitutional for the Military Commissions Act to deny habeas corpus rights to Guantanamo detainees, none of whom was an American citizen (indeed, the detainees were all foreign nationals outside of the U.S.). If the Constitution applied only to U.S. citizens, that decision would obviously be impossible. What’s more, although the decision was 5-4, none of the 9 Justices — and, indeed, not even the Bush administration — argued that the Constitution applies only to American citizens. That is such an inane, false, discredited proposition that no responsible person would ever make that claim.
What divided the Boumediene Court was the question of whether foreigners held by the U.S. military outside of the U.S. (as opposed to inside the U.S.) enjoy Constitutional protections. They debated how Guantanamo should be viewed in that regard (as foreign soil or something else). But not even the 4 dissenting judges believed — as Susan Collins and other claim — that Constitutional rights only extend to Americans. To the contrary, Justice Scalia, in his scathing dissent, approvingly quoted Justice Jackson in conceding that foreigners detained inside the U.S. are protected by the Constitution.

The principle that the Constitution applies not only to Americans, but also to foreigners, was hardly invented by the Court in 2008. To the contrary, the Supreme Court — all the way back in 1886 — explicitly held this to be the case, when, in Yick Wo v. Hopkins, it overturned the criminal conviction of a Chinese citizen living in California on the ground that the law in question violated his Fourteenth Amendment rights to due process and equal protection. Over 100 years ago, the Supreme Court explicitly said that the rights of the Constitution extend to citizens and foreigners alike. The Court has repeatedly applied that principle over and over.

This issue should have been resolved by the EHPD long ago.new policy's and special training. But since the Latinos were not of the chosen few it was ignored
Now every one is trying to Deni any wrong doing ever happened.

How many thousands of times has the New Haven Police stopped a white guy in a black neighborhood and asked "what are you doing down here". These car to car communications are trivial. If these offenses are indeed so serious, and the chief knew about it yet did nothing why was he not indicted? Are these officers being offered up to take a hit while the man responsible for that tiny department walks with a nice pension and no criminal liability? Something smells rotten.

18 U.S.C. 1621 : Outlaws presenting material false statements under oath in a Federal proceedings.
18 U.S.C. 1622 : Prohibits inducing or procuring another to commit perjury in violation of either section 1621 or 1623.
18 U.S.C. 1623 : Bars presenting material false statements under oath before or ancillary to a Federal court or grand jury.
Remember Yadanny Garcia? How many more have done the same. Where is his indictment? And going after those who talked him into making the claim, i.e. section 1622, Yale students, Manship. If the officers are wrong so be it. But the Fed's should not be one sided.

Really Jacabo? I just need to say to you and all of the people witho negative comment about our Police Officers "Innocent until Proven Guilty"! If you are so down on East Haven, just move away. You are an angry man. I moved here 9 years ago with my family from an affluent community in Fairfield County where I was born & raised, I have never experienced such warmth as I have here in EH, a wonderful community with good people, police officers, schools and other public servants. We have many fine organizations for our children as well. It is a melting pot of nationalities, creeds, colors & people exercising beliefs and sexual preferences just like everywhere else in the United States of America. It seems to me that most of the Latino families here have blended well into the schools and the work force, made way for new business and nice homes to live in, while at the same time there are those (of all faiths, nationalities and other beliefs) who have true 'chips on thier shoulders'. I have multi racial friends & relatives, those who are bi-sexual, straight, gay, and inter faithed. I have a spanish great nephew, my kids are friends to all, & never raised with blinders on. People who want freedom of living in America need to be bi-lingual, become citizens, get educations, & stop hiding behind prejudices just like my grandparents & the immigrants who came to Ellis Island for freedom and democracy, making America a great country. We all bleed & breath the same. Ignorance is NOT BLISS.

Oc spray stinks. The police spray it on surfaces that victims will either sleep or sit on. This makes the victim smell like dung when they get to court. It is a humiliating and degrading thing to do to a person. Zullo is a sick man.
